Life as a teenager can be chaotic — between school, home, friends, and extracurricular activities. Many teens view summer as a time for relaxation but for some, it’s all about the money. Summer jobs for teens should be fun, social, and flexible. Bearing this in mind it is also important to know that as a teen worker you have employment rights. Children and young people have specific rights under the following employment legislation:

  1. Protection of Young Persons (Employment) Act 1996
  2. Safety, Health and Welfare at Work (Children and Young Persons) Regulations 1998 SI 504/1998
  3. Protection of Young Persons (Employment) Act 1996 (employment in Licensed Premises) Regulations 2001 SI 350 /2001 – Includes a Code of Practice for guidance of employers and employees in connection with the employment of young people on licensed premises
  4. Education (Welfare) Act 2000

It is important to be clear about what is meant by children and young people as the regulations governing both groups are different. The Protection of Young Persons (Employment) Act 1996 defines

    • Children as being aged under 16
    • Young persons refer to those aged 16 or 17 years of age.

The Protection of Young Persons (Employment) Act 1996 generally prohibits the employment of children (i.e. those under 16) however there are some exceptions to this general rule:

  1. Employment authorised by the Minister for Jobs, Enterprise and Innovation in advertising, cultural, artistic and sporting activities.
  2. Over 14 yrs – A child who is over 14 may do light work outside school term where the hours do not exceed 7 in any day or 35 in any week. Slightly longer hours are allowed in work experience programmes, for example, as part of a transition year programme. Such children must, however, have a complete break of at least 21 days during the summer holidays.
  3. Over 15, but under 16, may work up to 8 hours a week doing light work in school term time.
  4. Children may be employed by a close relative in, for example, a family business doing non-industrial work. Even allowing for these exceptions to the general rule, a child under 16 may not work between 8pm and 8am. The Act also lays down minimum rest periods and breaks, including at least a 30-minute break in a 4-hour work period.

Employment of young persons (those aged 16 or 17 years of age) is less restricted than that of a child. However, there are still important points to note. For example,

    • There is a maximum working day of 8 hours.
    • There is a maximum working week of 40 hours.
    • Generally, a young person may not be employed between the hours of 10pm and 6am.
    • Rest periods and breaks must include at least a 30-minute break in a four and a half hour working period.
    • Where a young person (that is, a 16 or 17 year old) is employed on licensed premises, he/she may be required to work up to 11pm on any day which is not immediately followed by a school day for that young person. However, work on the following day cannot start before 7am. The work involved on the licensed premises must be general duties only not involving the sale of alcoholic drink at the bar or in an off-licence.

Before employing a child or a young person, an employer should request a copy of the employee’s birth certificate to verify the age and, in the case of a child, a letter of consent from his/her parent or guardian. While employing a child or young person, the employer is obliged to keep records of the employee’s details, date of birth and so on, and of the hours worked by the employee. Employers should retain these records for at least 3 years as the onus is on the employer to show that the law has been complied with. In addition, the employer should display a summary of the legal provisions at the place of work and give the child or young person a copy of the summary within one month of starting.

The Minimum Wage in Ireland in 2012 for someone less than 18 years of age is €6.06.

Where a child or young person considers that he/she has been victimised for seeking to have the legislation applied (for example, by refusing to work prohibited hours), then a complaint may be referred to a Rights Commissioner. An employer who employs a young person or child contrary to the Act is liable to prosecution. Inspectors from the Department of Enterprise, Trade, and Employment have responsibility for enforcing the legislation.

Once you know your rights the next step is to find the job. My tips are to:

  1. Check with your secondary school career guidance office and ask how they can assist with your job search. They may have postings for local businesses.
  2. Next, tell everyone you know that you’re looking for work. Speak with teachers, family, coaches, friends, parents of friends – anyone and everyone you can think of – and ask for help. Most jobs are found through recommendations and people you know are often happy to assist.
  3. Consider your own skills and interests as well as the needs of the local economy where you will be spending your summer. Restaurants, supermarkets, newsagents, lesiureplexes are all good places to start looking for a job. Also try golf clubs, busiest time of the year for them. Lots of them look for students during the summer.
  4. Print about ten to fifteen CVs and just walk around the different shops in your local area. Once you go into the shop its best to ask for a manager to personally hand the CV to him or her. Try to look neat as well. First impressions are everything.

On the 20th March I gave a talk to St Mary’s Secondary School, Macroom, Co. Cork. Session one was to 5th years and session two was to 6th years. It was all part of the school’s initiative of: ‘Health is wealth’ week.

I spoke with the students about my personal story. I told them what I have learnt from life is the following:

D         Different

E          Emotional Intelligence

W        Why

Different

Being different is ok. When I was in secondary school I always wanted to fit in rather than stand out. But what I have learnt from life is that it’s ok to stand out and not to be ashamed of yourself. When we value difference in each individual we truly accept them. What I have learnt from life is for others to love you then you have to love yourself first and self-accept yourself. Once you accept yourself then you wont care about being different, you wont be so caught up in trying to be part of the: ‘make-up’ girls gang.

Emotional intelligence

What I have learnt from life is that understanding how you think and feel will help you overcome obstacles and bounce back quicker. Normally if I encounter an obstacle I:

A         Acknowledge my emotion

U         Understand my emotion

M         Move on from it

Self-awareness skills will help you identify the reason you think and feel certain ways. In turn, allowing you to recognise and find ways to move past your emotion. For example, when I went to Mexico horseriding before I got on the horse I felt huge: ‘fear.’ Fear can stop us from achieving our goals so I was lucky that I was able to acknowledge and understand why I was feeling so afraid.  To move past my fear I began to ask myself questions: What exactly am I afraid of? When you ask yourself the right questions it can get to the bottom of the fear. I was afraid of falling off the horse and ending up with a second disability and one disability is bad enough. I was able to tame my emotion by understanding it. In turn, I overcame my fear and went horseriding. Achieving that goal made me feel very proud of myself because for years I stopped myself from going horseriding because I was too afraid of falling off.

Why

The third part of DEW is why. The why of life is very important to bounce back from disappointments. What is your purpose in life? The next time you get a disappointment, a setback, a hurt, think of the why that makes you want to keep on going. We all have a purpose. So when you run out of money, when things don’t work out for you, when things happen that couldn’t have been anticipated, what are the reasons that you can think of to keep you strong and in the game? When the messenger of misery comes your way think to yourself why is it that you deserve your goal. Find that reason.

I thoroughly enjoyed talking with the teachers and pupils at St. Mary’s Secondary School. I will keep on striving to inspire people.
